1. Acceptance of Terms
Welcome to The Body Place LLC ("The Body Place LLC," "Company," "we," "our," or "us").
By accessing our website, purchasing tickets, registering for events, attending classes, workshops, retreats, community gatherings, or otherwise using our services, you agree to be bound by these Terms of Service, our Privacy Policy, Website Disclaimer, and any additional agreements, waivers, policies, or participation requirements applicable to specific offerings.
If you do not agree to these Terms, you may not use our website or services.
2. Eligibility
Unless expressly stated otherwise, our website, services, classes, workshops, events, retreats, and offerings are intended for individuals eighteen (18) years of age or older.
By participating, you represent and warrant that you meet all eligibility requirements and possess the legal authority to enter into binding agreements.
3. Nature of Services
The Body Place LLC provides educational, recreational, wellness, movement, mindfulness, community-building, and personal development experiences, including but not limited to:
Yoga classes
Meditation sessions
Workshops
Educational programs
Community gatherings
Retreats
Events
Digital resources
Online content
Future offerings
Services may be modified, expanded, suspended, or discontinued at any time without notice.
4. No Medical, Mental Health, Legal, or Professional Advice
The Body Place LLC does not provide medical care, psychotherapy, counseling, psychiatric treatment, diagnosis, legal advice, financial advice, or any other licensed professional services.
All content, materials, communications, workshops, classes, events, retreats, and resources are provided solely for educational, informational, recreational, and community purposes.
Participation does not establish a therapist-client, physician-patient, attorney-client, fiduciary, or other professional relationship.
Participants remain solely responsible for their own decisions, actions, health, safety, and well-being.
5. Assumption of Risk
Participation in yoga classes, workshops, retreats, educational events, movement practices, mindfulness activities, outdoor activities, travel-related experiences, and community gatherings involves inherent risks that cannot be eliminated regardless of the level of care exercised.
These risks may include, without limitation:
Physical injury
Muscle strains
Falls
Illness
Emotional discomfort
Property loss
Travel-related incidents
Exposure to communicable illness
Unforeseen accidents
Serious injury
Permanent disability
Death
By participating, you knowingly, voluntarily, and expressly assume all risks associated with participation.
6. Participant Responsibility
Participants are solely responsible for determining whether participation is appropriate for them.
Participants agree to:
Listen to their body and personal limits
Seek appropriate medical advice when necessary
Follow instructions and safety guidelines
Discontinue participation when appropriate
Act responsibly and respectfully
Maintain awareness of their own physical, mental, and emotional condition
Participation is voluntary at all times.
7. Waivers & Additional Agreements
Participation in certain offerings may require execution of additional documents, including:
Liability waivers
Participation agreements
Retreat agreements
Emergency contact forms
Venue-specific agreements
Code of conduct acknowledgments
The Body Place LLC reserves the right to deny participation to any individual who fails to complete required documentation.
These Terms supplement and do not replace any separately executed agreement.
8. Registration & Attendance
Participants are responsible for providing accurate registration information and complying with all event requirements.
Registration does not guarantee continued participation if safety concerns, policy violations, venue requirements, or other legitimate concerns arise.
Non-Transferability
Registrations, reservations, tickets, memberships, and participation rights are personal to the registered participant and may not be transferred, assigned, resold, gifted, or otherwise conveyed without prior written consent from The Body Place LLC.
9. Right to Refuse or Remove Participants
The Body Place LLC reserves the right to deny, suspend, limit, or terminate participation at any time, with or without notice, when reasonably necessary to protect:
Participant safety
Community well-being
Professional boundaries
Business operations
Legal compliance
Venue requirements
Reasons may include, but are not limited to:
Harassment
Discrimination
Threatening behavior
Disruptive conduct
Boundary violations
Intoxication
Failure to comply with policies
Safety concerns
Removal may occur without refund.
10. Community Conduct
Participants agree to engage respectfully and professionally.
Participants shall not:
Harass others
Discriminate against others
Violate participant privacy
Record others without consent
Engage in unlawful conduct
Disrupt events or activities
Interfere with the safety or enjoyment of others
The Body Place LLC reserves the right to remove participants who violate community standards.
11. Refund Policy
All sales are final.
Refunds are not guaranteed and generally will not be issued.
Refund requests may be considered only in documented emergency circumstances and solely at the discretion of The Body Place LLC.
Approval or denial of any refund request shall be final.
No-shows, scheduling conflicts, personal preferences, changes of mind, travel issues, weather conditions, scheduling errors, or inability to attend do not automatically qualify for refunds.
12. Event Changes & Force Majeure
The Body Place LLC reserves the right to modify, relocate, reschedule, substitute, postpone, or cancel any offering when reasonably necessary.
The Body Place LLC shall not be liable for delays, interruptions, cancellations, or modifications caused by circumstances beyond its reasonable control, including:
Severe weather
Natural disasters
Public health emergencies
Government actions
Venue issues
Transportation disruptions
Utility failures
Labor disputes
Acts of God
Technology failures
Security concerns
13. Intellectual Property
All content provided by The Body Place LLC, including but not limited to:
Logos
Branding
Website content
Text
Graphics
Designs
Audio recordings
Videos
Educational materials
Course materials
Workshop materials
Digital resources
is owned by or licensed to The Body Place LLC and protected by applicable intellectual property laws.
No content may be copied, reproduced, distributed, displayed, published, adapted, modified, sold, licensed, transmitted, reverse engineered, or otherwise exploited without prior written permission.
Unauthorized use may result in legal action.
14. Photography & Media
Participants may not photograph, record, livestream, or otherwise capture participants without their express consent.
The Body Place LLC will not use a participant's image, likeness, voice, testimonial, or identifying information for promotional purposes without prior written consent.
15. User Content
Any reviews, testimonials, comments, suggestions, feedback, communications, or other materials voluntarily submitted to The Body Place LLC may be used for operational, educational, marketing, or business purposes unless otherwise prohibited by law or agreed in writing.
Users represent that they possess all rights necessary to submit such content.
16. Third-Party Services
The Body Place LLC may utilize third-party providers including Eventbrite, Stripe, Squarespace, email providers, scheduling systems, analytics providers, and similar services.
The Body Place LLC is not responsible for the content, security, availability, practices, or policies of third-party providers.
17. Website Availability
The Body Place LLC does not guarantee uninterrupted access to its website, communications, services, or online platforms.
The Company reserves the right to modify, suspend, restrict, discontinue, or remove any portion of its website, content, offerings, or functionality at any time without notice or liability.
18. Insurance Disclaimer
Participants are solely responsible for obtaining and maintaining any health, medical, accident, travel, disability, personal property, or other insurance coverage they deem appropriate.
Participation does not create any obligation for The Body Place LLC to provide insurance coverage for participants.
19. No Guarantees
The Body Place LLC makes no guarantees regarding:
Results
Experiences
Outcomes
Wellness improvements
Educational outcomes
Personal growth
Community experiences
Each participant's experience is unique.
20. Limitation of Liability
To the fullest extent permitted by law, The Body Place LLC, its owners, members, officers, employees, contractors, volunteers, facilitators, representatives, successors, assigns, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, exemplary, emotional distress, business interruption, travel-related, lodging-related, or other damages arising from participation in or use of any website, event, class, workshop, retreat, service, or offering.
Where liability cannot be fully excluded, liability shall be limited to the amount paid by the participant for the specific offering giving rise to the claim.
21. Indemnification
You agree to defend, indemnify, and hold harmless The Body Place LLC and its owners, members, employees, contractors, volunteers, facilitators, representatives, successors, assigns, and affiliates from and against any claims, damages, liabilities, losses, costs, expenses, or attorneys' fees arising from:
Your participation
Your conduct
Your violation of these Terms
Your violation of applicable laws
Claims brought by third parties relating to your actions
22. Investigation of Violations
The Body Place LLC reserves the right to investigate suspected violations of these Terms, applicable laws, community standards, venue rules, participant agreements, or safety requirements and may cooperate with law enforcement, insurers, venues, legal counsel, or regulatory authorities when appropriate.
23. No Agency Relationship
Nothing in these Terms shall be construed to create a partnership, joint venture, employment relationship, fiduciary relationship, agency relationship, or similar legal relationship between The Body Place LLC and any participant, attendee, customer, volunteer, contractor, or website visitor.
24. Future Retreats & Travel
Certain offerings may involve travel, lodging, transportation, outdoor activities, third-party venues, or retreat experiences.
Participants acknowledge that such offerings involve additional risks and may require separate agreements, waivers, disclosures, participation requirements, and policies.
25. Reservation of Rights
The Body Place LLC reserves all rights not expressly granted under these Terms.
Failure to enforce any provision shall not constitute a waiver of any right.
26. Electronic Communications & Signatures
Electronic communications, registrations, acknowledgments, agreements, and signatures shall have the same legal effect as written documents and handwritten signatures.
27. Governing Law & Venue
These Terms shall be governed by the laws of the State of Colorado.
Any dispute arising out of or relating to these Terms, the website, or any offering shall be brought exclusively in the state or federal courts located within Colorado, and all parties consent to such jurisdiction and venue.
28. Entire Agreement
These Terms, together with the Privacy Policy, Website Disclaimer, waivers, event registrations, retreat agreements, participation agreements, and any other written agreements executed between the parties, constitute the entire agreement regarding the subject matter herein and supersede all prior discussions, communications, understandings, or representations.
29. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
30. Survival
Any provisions that by their nature should survive termination, including intellectual property rights, limitation of liability, indemnification, dispute resolution, governing law, record retention, and related obligations, shall survive termination of these Terms.
31. Changes to These Terms
The Body Place LLC reserves the right to update or modify these Terms at any time.
Updated Terms will be posted with a revised effective date. Continued use of the website or participation in offerings constitutes acceptance of any revisions.
